Acceptance of Terms

These Terms and Conditions ("Terms") govern your purchase and use of TheOmarObaid.co’s digital products (such as downloadable PDF workout plans), online consultation services (e.g., video/voice calls), and remote personal training support (e.g., WhatsApp-based communication).

By checking the agreement box and completing a purchase, you confirm that you have read, understood, and agreed to these Terms as a binding legal agreement.

If you do not agree to any part of these Terms, you must not purchase or use our products or services.

Users may complete a purchase either as guests or through a registered account. In all cases, agreement to these Terms is required prior to checkout and constitutes a legally binding electronic signature.

You represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction), or that you have obtained consent from a parent or legal guardian.

You further confirm that you are not purchasing on behalf of another person or using a false identity to access services.

Where a purchaser is below the age of 18 and purchases or uses a product with parental or guardian consent, that parent or legal guardian acknowledges these Terms and accepts responsibility for supervising the minor's use of the product.

Mandatory Law and Consumer Rights

Nothing in these Terms is intended to exclude, waive, restrict, or override any right, remedy, duty, or obligation that cannot lawfully be excluded under the mandatory laws of the State of Kuwait.

Any disclaimer, waiver, release, limitation of liability, refund restriction, jurisdiction provision, or other contractual protection contained in these Terms shall apply to the fullest extent permitted by applicable law.

If any provision of these Terms conflicts with a mandatory provision of applicable law, that mandatory provision shall prevail only to the minimum extent legally required, while the remainder of these Terms shall continue to apply.

Accounts and Purchase Process

When creating an account, you agree to provide accurate, current, and complete information and to maintain the confidentiality of your login credentials.

If you use guest checkout, you must provide a valid email address  your digital product will be delivered to that address.

If the email address is incorrect or inaccessible, TheOmarObaid.co bears no responsibility for failed delivery.

In such cases, the user accepts full responsibility but may contact our support team at [email protected], and we will make reasonable efforts to assist.

We reserve the right to suspend or cancel accounts or orders if we suspect fraud, abuse, or violation of these Terms.

Any attempt to access, modify, or interfere with another user’s account or purchase history is a violation of applicable laws.

You are responsible for ensuring that all information supplied during checkout, including your name and email address, is correct before completing payment.

Digital Products & Consultations

Digital Products

Your purchased workout plan will be delivered via email (as an attachment or download link).

Please double-check your email address and inspect your spam/junk folder.

If you do not receive your file within 72 hours, contact [email protected] immediately. Delayed communication may result in forfeiture of access.

We do not provide technical support related to personal devices, email platforms, or third-party applications.

You will receive the digital product in the language selected at checkout (Arabic or English). Language selection is final - changes cannot be made post-purchase. If you require an additional version, you must purchase it separately.

Customer Email and Delivery Responsibility

The purchaser is solely responsible for providing a complete, accurate, accessible, and functioning email address during checkout.

During the seventy-two (72) hours following an order, the purchaser is responsible for checking the supplied email account, including its inbox, spam folder, junk folder, promotions folder, blocked-sender folder, quarantine folder, and any similar email-filtering location.

If the purchased product has not been received within seventy-two (72) hours of the order, the purchaser must contact [email protected] and provide sufficient order information for the transaction to be identified.

Failure to check the purchaser's email account within this period does not constitute non-delivery by TheOmarObaid.co where the product was correctly dispatched.

TheOmarObaid.co shall not be responsible for delivery problems caused by:

• an incorrect or misspelled email address supplied by the purchaser;

• an inaccessible, suspended, deleted, or full mailbox;

• spam or junk filtering;

• blocked emails or sender restrictions;

• corporate, university, governmental, or provider-level email filtering;

• technical limitations affecting the purchaser's device or email provider;

• or other circumstances outside our reasonable control.

The purchaser must notify us as soon as reasonably possible if they discover that incorrect contact information was supplied.

Nature of Digital Fitness Products

Workout plans, eBooks, exercise demonstrations, videos, written instructions, tables, recommendations, and other fitness materials provided through TheOmarObaid.co are intended for general educational and fitness purposes.

Unless a service or product is expressly described as individually personalized, a digital workout plan is not individually designed around the purchaser's complete medical history, injuries, disabilities, medication use, surgical history, pregnancy status, cardiovascular condition, anatomical limitations, or other personal medical circumstances.

Purchasing an eBook or general workout program does not establish a physician-patient, physiotherapist-patient, psychologist-patient, dietitian-client, or other medical relationship with TheOmarObaid.co or Omar Obaid.

Consultation Services

Consultations are conducted through voice or video conferencing platforms.

You are responsible for ensuring stable internet connectivity and access to appropriate hardware/software.

All consultation bookings are final - no cancellations or refunds are permitted under any circumstances.

Recording of sessions is strictly prohibited. You may, however, take notes during the call if desired.

You acknowledge and agree that TheOmarObaid coaching style is based on the fact that he is a certified Behavior Change Specialist, direct, assertive, and performance-focused. Tone, language, or approach shall not be grounds for complaint, refund, or legal recourse.

TheOmarObaid does not provide mental health counseling or therapeutic services.

WhatsApp-Based Personal Training

Certain training programs include personalized communication through WhatsApp, including voice notes, messages, images, and progress feedback. By enrolling, you agree that:

• You are voluntarily engaging in remote fitness coaching.

• All communication is confidential and must not be copied, altered, forwarded, or publicly shared.

• TheOmarObaid.co is not liable for injuries, misunderstandings, or misapplication of instructions carried out without supervision.

• This service is private and protected under applicable intellectual property and confidentiality laws.

Screenshots, recordings, or public sharing of any private conversation is a violation of these Terms and may lead to legal consequences.

TheOmarObaid.co reserves the right to use before/after progress images on social media for promotional purposes - provided the client’s face is blurred or covered.

Code of Conduct & Coaching Style Disclaimer

TheOmarObaid.co programs are intentionally designed to reflect a tough-love, high-discipline coaching style. You acknowledge and agree that:

• You are participating voluntarily in a structured coaching experience led by a certified professional.

• Communication may be assertive, intense, or emotionally challenging - this is by design and not to be misconstrued as offensive or inappropriate.

• Coaching tone, style, or delivery is not subject to refund, complaint, or defamation, and cannot be used as grounds for legal action of any kind.

• If you are seeking emotional comfort, sympathy, or therapeutic support, this program is not suitable for you.

• Omar retains full autonomy over his coaching methodology, delivery style, and client engagement model.

Any restrictions or waivers in this section apply only to the fullest extent permitted by mandatory applicable law.

Download Policy

If your product is delivered via download link/Email, access may be time-limited or restricted to a specific number of downloads.

Once downloaded, the file becomes your sole responsibility to store and maintain.

We are not obligated to resend files at a later time. You are fully responsible for your own device storage, backup, and internet connection.

Delivery of one digital copy does not authorize the purchaser to create or distribute additional copies to other persons.

Personal, Non-Transferable License

Purchase of a digital product does not transfer ownership of that product or any intellectual-property right contained within it.

The purchaser receives only a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the purchased product for the purchaser's own personal fitness purposes, subject to these Terms.

The license belongs exclusively to the person associated with the purchase and may not be transferred, sold, gifted, assigned, loaned, sublicensed, or shared with another individual.

Purchasing one copy means one user.

The purchaser may not provide the eBook, PDF, video links, screenshots, program material, or any substantial portion of the product to a friend, spouse, family member, personal trainer, coach, client, colleague, gym member, online community, or any other person.

The fact that no money is charged for sharing does not make the distribution authorized.

No Sharing Policy

All digital plans are licensed for single-user access only. You are strictly prohibited from:

• Sharing files, video links, or private content with others

• Posting screenshots or excerpts from plans or consultations

• Uploading any material to social media or websites

• Removing, editing, or hiding watermarks, branding, or logos

Violations will result in immediate service termination and may lead to legal claims for financial damages.

All content is digitally traceable and protected by copyright.

The use of AI, machine learning tools, or automated systems to replicate or extract any content is strictly prohibited.

Serial Codes, Purchaser Identification and Traceability

Each eBook or digital workout product may be issued with a unique serial code, identifier, watermark, order reference, or other digital identification mechanism.

Where such identification is used, the identifier is associated with the purchaser's order record and/or the email address supplied at checkout.

Accordingly, a copy discovered outside the purchaser's authorized personal possession may be capable of being traced back to the email address, order, account, or transaction through which that specific copy was originally issued.

The purchaser must therefore protect the purchased file from unauthorized access and must not forward, upload, lend, distribute, or otherwise provide it to another person.

The purchaser must not:

• modify or remove a serial code;

• obscure purchaser-identification information;

• crop, cover, replace, edit, or remove a watermark;

• alter a file for the purpose of defeating traceability;

• create a clean or unmarked copy;

• or assist another person in bypassing any anti-piracy measure.

Serial numbers, order records, delivery records, purchaser details, and digital identifiers may be used to investigate suspected unauthorized distribution and may be relied upon as evidence to the extent permitted by applicable law.

The use of serial identifiers does not transfer ownership of the user's email address or personal information and shall be handled subject to applicable privacy and data-protection requirements.

Unauthorized Distribution and Enforcement

Unauthorized reproduction, forwarding, uploading, resale, sharing, publication, or distribution of TheOmarObaid.co materials may constitute both a breach of these Terms and an infringement of applicable intellectual-property rights.

Where infringement or unauthorized distribution is discovered, TheOmarObaid.co and/or the applicable intellectual-property owner reserves the right, to the fullest extent permitted by law, to:

• terminate access;

• revoke licenses;

• preserve evidence;

• issue takedown notices;

• contact websites, hosting providers, social-media platforms, payment providers, marketplaces, cloud providers, or other relevant intermediaries;

• seek injunctive or protective relief;

• pursue compensation for proven losses or damages;

• recover enforcement costs where legally recoverable;

• and pursue any other remedy available under applicable law.

A purchaser must not knowingly enable another person to access or distribute the purchased product.

Pricing and Payment

All prices are displayed in Kuwaiti Dinar (KWD).

Payment must be completed through secure third-party payment processors at checkout.

If your payment is declined, reversed, or disputed (e.g., chargeback), we reserve the right to revoke access to any purchased content.

Fraudulent chargebacks will be treated as legal offenses, and compensation may be pursued accordingly.

TheOmarObaid.co is not responsible for interruptions, bank restrictions, payment-provider outages, card-issuer failures, exchange-rate calculations, or other payment-processing conditions controlled by third parties.

Intellectual Property Rights

All content - including but not limited to workout plans, branding assets, logos, slogans, PDF documents, illustrations, and written material - is the exclusive property of TheOmarObaid.co.

No content may be copied, modified, resold, or distributed - whether for commercial use or otherwise - without prior written consent.

Use of our brand to create imitation accounts, fake content, or derivative programs is strictly prohibited and subject to legal action.

Ownership of Website, Brand and Creative Materials

All rights, title, and interest in TheOmarObaid.co and its original protectable materials are reserved by their lawful owner.

This includes, to the fullest extent protected by applicable law:

• the TheOmarObaid.co website and its original content;

• original website copy and written materials;

• eBooks;

• workout plans;

• program structures and original selection, arrangement, organization, and presentation;

• exercise descriptions;

• educational materials;

• tables and written programming;

• original graphics;

• photographs;

• illustrations;

• product covers;

• digital downloads;

• exercise videos and demonstrations;

• audiovisual content;

• logos;

• branding;

• trade names;

• slogans;

• visual identity;

• original design elements;

• marketing materials;

• original creative concepts as expressed in protected written, graphic, audiovisual, or other fixed form;

• and any other original material protected under applicable intellectual-property law.

Purchasing a product grants only the limited personal license described in these Terms.

It does not transfer copyright, trademark rights, ownership, commercial rights, reproduction rights, distribution rights, or any other intellectual-property interest to the purchaser.

Except where expressly authorized in writing or permitted by mandatory law, no person may copy, reproduce, republish, distribute, transmit, sell, sublicense, translate, modify, adapt, extract, publicly display, publicly perform, commercially exploit, or create unauthorized derivative materials from protected content.

No person may use TheOmarObaid name, TheOmarObaid.co, its logos, branding, visual identity, covers, product appearance, or other identifying elements to create, promote, market, imitate, or sell another product, service, website, social-media account, coaching business, workout program, or commercial offering without written authorization.

For clarity, intellectual-property law may distinguish between an abstract idea or training method and the protected expression of that idea. Nothing in these Terms claims exclusive ownership over material that applicable law does not permit to be exclusively owned. However, TheOmarObaid.co expressly reserves all rights in its original written expression, audiovisual execution, design, organization, compilation, presentation, branding, and other legally protectable elements.

All rights not expressly granted are reserved.

TheOmarObaid.co does not offer medical advice. All content is educational and fitness-focused.

By using our services, you confirm that:

• You are medically cleared to participate in physical exercise

• You accept full responsibility for your health, form, technique, and outcomes

• You release TheOmarObaid.co and Omar Obaid from any liability related to injury, illness, or physical complications - even if partially linked to program guidance

• You accept all risks inherent in physical activity, whether supervised or self-directed

Any release or limitation in this section applies to the fullest extent permitted by mandatory applicable law.

Assumption of Exercise Risk

Resistance training, weightlifting, cardiovascular activity, mobility work, stretching, bodyweight exercise, gym equipment, free weights, machines, cables, and physical exercise generally involve inherent risks.

Possible risks include, without limitation:

• muscle soreness;

• strains;

• sprains;

• falls;

• loss of balance;

• joint injury;

• tendon or ligament injury;

• aggravation of pre-existing injuries;

• cardiovascular complications;

• accidents involving equipment;

• and other temporary or permanent physical complications.

By choosing to perform an exercise contained within a TheOmarObaid.co product, the user acknowledges that physical activity involves risk and voluntarily assumes the inherent risks associated with participation.

The purchaser is responsible for choosing appropriate resistance, repetitions, range of motion, exercise variation, equipment, training environment, and progression according to the purchaser's individual capabilities.

Medical Clearance and Duty to Stop

The purchaser is responsible for determining whether medical clearance is appropriate before beginning any workout program.

A purchaser should obtain advice or clearance from an appropriately qualified healthcare professional before exercising where the purchaser has, or suspects they may have:

• an injury;

• cardiovascular disease or symptoms;

• musculoskeletal conditions;

• neurological conditions;

• previous surgery;

• pregnancy;

• chronic disease;

• medication-related exercise restrictions;

• unexplained or persistent pain;

• or another condition that may affect safe participation in exercise.

If a user experiences chest pain, fainting, severe or unusual shortness of breath, dizziness, neurological symptoms, sudden or severe pain, or another concerning symptom, the user should stop exercising and obtain appropriate medical attention.

The absence of a specific warning about a particular medical condition does not mean that a particular exercise is safe or medically suitable for every individual.

No Live Supervision for Digital Products

Unless a product or service expressly states that live supervision is included, digital workout plans and eBooks are performed independently by the purchaser.

Omar Obaid and TheOmarObaid.co cannot observe the purchaser while the purchaser performs exercises from a general digital program.

The purchaser therefore remains responsible for:

• exercise technique;

• equipment setup;

• equipment condition;

• training environment;

• resistance selection;

• spotting arrangements where appropriate;

• range of motion;

• progression;

• and personal safety.

Purchasing an eBook does not create an obligation for TheOmarObaid.co to supervise each workout or verify the purchaser's exercise execution.

Execution and Implementation Responsibility

A digital workout plan provides information, structure, programming, demonstrations, and instructions.

It cannot perform the workout on behalf of the purchaser.

Lack of progress, inability to feel a particular muscle, difficulty completing a prescribed repetition range, inability to perform an exercise, or failure to achieve an expected physical outcome does not by itself establish that a digital product is defective.

Results and exercise performance may depend on factors including:

• consistency;

• execution;

• technique;

• resistance selection;

• training effort;

• recovery;

• sleep;

• nutrition;

• adherence;

• prior training history;

• individual anatomy;

• and individual biological response.

The purchaser is responsible for reading the instructions, reviewing the available exercise demonstrations, using appropriate judgment, and implementing the program according to personal ability.

If a movement cannot be performed safely or comfortably, the purchaser should not force the exercise merely to complete the program.

Limitation of Liability

To the fullest extent permitted by applicable law, TheOmarObaid.co, Omar Obaid, its operator, contractors, affiliates, representatives, and service providers shall not be responsible for indirect, incidental, consequential, special, exemplary, or economic losses arising from the purchase, access, attempted use, misuse, incorrect implementation, independent execution, or inability to use a digital fitness product.

To the fullest extent permitted by applicable law, any aggregate contractual liability arising directly from a specific digital-product transaction shall be limited to the amount actually paid by the purchaser for the specific product giving rise to the claim.

Nothing in these Terms excludes or limits liability, consumer rights, or legal obligations that cannot lawfully be excluded or limited under mandatory Kuwaiti law.

No Guarantee of Results

Every individual's results may vary. Your success depends on your effort, diet, mindset, and overall lifestyle.

We do not guarantee:

• Muscle gain, fat loss, or physical transformation within a specific timeframe

• Motivation, confidence, or mental performance outcomes

You are receiving a complete and proven framework - your results are determined by how you implement it.

No testimonial, transformation photograph, social-media post, example result, client story, or promotional material represents a guarantee that another purchaser will obtain identical or comparable results.

Third-Party Platforms and External Links

Digital products or services may rely on or contain links to third-party platforms and providers, including:

• YouTube or other video-hosting platforms;

• email providers;

• payment processors;

• messaging applications;

• cloud-storage services;

• telecommunications services;

• web-hosting providers;

• and other external technology services.

TheOmarObaid.co does not own or control the availability, technical performance, policy decisions, service interruptions, account restrictions, or continued operation of independent third-party platforms.

Temporary failure or unavailability of a third-party service does not automatically render the underlying digital product defective.

Website Availability and Force Majeure

Refund Policy

All digital sales are final. No refunds, cancellations, or exchanges will be granted for any reason.

Where permitted by applicable law, successful electronic delivery, access, download, or use of a digital product may constitute commencement or consumption of the applicable digital product or service and may affect any right to cancel, withdraw, or request a discretionary refund.

Privacy and Data Protection
